Who can ask for Refugee Protection in Canada?

Canada's Refugee Protection System helps people who have fled their country of citizenship or permanent residence because of a well-founded fear of persecution. This means that some people can ask for refugee protection in Canada if returning to their country would put them in danger. 

How to ask for refugee protection?

In all cases, the process of refugee protection starts by submitting an application to an officer (CBSA, IRCC).

At the airport (POE)

You may apply for refugee protection at the Port of Entry (Airport, Seaport or Land Border) by providing information to an officer (Canada Border Services Agency, commonly known as CBSA) orally in an interview or through a combination of a written application form and an oral interview. CBSA will assess your admissibility, initiate the background verification process, collect your biometric information, issue a conditional removal order, and decide whether your claim is eligible to be referred. 
If your claim is deemed eligible, a CBSA officer will issue a confirmation of referral and provide you with a Basis of Claim (BOC) form. The claim will be referred to the Refugee Protection Division (RPD) of the Immigration and Refugee Board of Canada (IRB). RPD will send you a Notice to Appear for a Hearing.

Note: You have 15 days to send your Basis of Claim to the Refugee Protection Division from.

Inland Claim (Inside Canada)

You can apply for refugee protection from within Canada by submitting an online application to the Immigration, Refugee and Citizenship Canada (IRCC). For the online application, you must provide your completed Basis of Claim (BOC) form to the IRCC officer. The officer will assess your application and decide whether your claim is eligible to be referred to the  Refugee Protection Division (RPD) of the Immigration and Refugee Board of Canada (IRB). If your claim is deemed eligible, the IRCC officer will issue a confirmation of referral. RPD will send you a Notice to Appear for a Hearing. 

As per the new rules for refugee protection, claims made on and after June 3, 2025. Your claim will be deemed ineligible to be referred to the IRB if

• You made the claim more than one year after your first entry to Canada. This is applicable if you entered Canada after June 24, 2020, even if you subsequently left the country.
•  You waited more than 14 days to submit the claim after you entered Canada along the Canada-US land border. Unaccompanied minors are exempt.
